Newest DJI Phantom 3 Quad Copter Drones and Legal Issues

By Howard Berenbon

Christmas is on the way, and many of those gifts under the evergreen tree will be drones, some inexpensive (with a camera) starting at $80 and several from $600 to $1,300 or more (from DJI) with sophisticated programmable electronics, GPS location and homing features and gyroscope stabilization. The more expensive quad copters include high definition cameras for recording professional looking aerial videos useful for commercial applications and longer battery life for up to 25 minutes flying time. For the professional photographer, the quad copter capability can enhance your services with video fly-bys for the entertainment, advertising or real estate applications.

Legal Implications

The FAA is now establishing laws for the millions of drones they anticipate sold as Christmas gifts. They are considering requiring registration of any quad copter weighing 8 ounces or more. Current restrictions do not allow flying quad copters within 5 miles of an airport, in US National Parks and near military bases. Also, because of danger to aircraft (getting sucked into an engine), you are prohibited to fly your drone above 400 or 500 feet, even if you are not near an airport. Other restrictions may apply to your local area. Before you fly, check with your city or county for any local restrictions. If you are a professional, and plan on using quad copter for commercial applications, consult with an experienced attorney before you proceed.

12/14/2015: Drone/Quadcopter Update:

The FFA decided today that all Drones/Quadcopters from 1/2 lb to 55 lbs require registration. Registration requires name, physical address and e-mail address. Penalty for flying a drone in restricted airspace is $1100.
